HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.17028 of 2018 ORDER:

This writ petition is filed with the following prayer: " .....to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, to declare the action of the official respondents as illegal and arbitrary in not giving protection to the petitioner from the unofficial respondent and consequently direct the official respondents to give protection to the petitioner from the unofficial respondent and pass such other order or orders as this Honourable Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner, who submits that since the petitioner has filed criminal case against the 4th respondent, the 4th respondent is threatening the petitioner with dire consequences and he needs police protection. Written instructions are produced by the learned Assistant Government Pleader for Home stating that on the complaint of the petitioner and after obtaining permission from the Judicial Magistrate of First Class, Kurnool, a case in Cr.No.59 of 2018 was registered for the offence punishable under Section 506 read with Section 155(3) Cr.P.C. of Kodumur Police station. It is also stated that there are business disputes between the petitioner and unofficial respondent. But no cases are registered against each other. It is also stated that the Station House Officer is not authorized to give protection.

It is to be seen that if the petitioner requires any police protection, it is open for the petitioner to make application to the

2nd respondent and the 2nd respondent is directed to consider the same and dispose of the same as expeditiously as possible, in accordance with law, as and when such application is made by the petitioner.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
