O R D E R

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in Crime No.169 of 2026 before the Wankidi Police Station, Wankidi (Asifabad-R), Kumurambheem Asifabad, registered for the offences punishable under Sections 75(2), 78(2) and 351(2) of BNS.

The brief facts of the case are that, the accused contacted the de-facto complainant through Instagram, obtained her phone number, and started communicating with her. During video calls, he captured her photographs and later followed and harassed her, forcing her to accept his advances. When the complainant's marriage was fixed, the accused sent her photographs to the prospective groom and threatened them with dire consequences, resulting in the cancellation of the marriage. Based on the said complaint, the police registered a case for the aforesaid offence. 3.

Heard Sri Khammam Srinivas, learned counsel for petitioner as well as Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the present case. It is submitted that there is no direct evidence to substantiate the allegations and that the complaint is exaggerated. It is also submitted that the petitioner has been in judicial custody since 14.05.2026. It is also submitted that the material part of the investigation has already been completed. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner is serious in nature and as such, petitioner has harassed the victim, captured her photographs without consent, and used them to threaten and interfere with her proposed marriage. Further, the investigation is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail since 14.05.2026. As seen from the record, LW.1 to 9 were already examined and the investigation has been completed. Considering the facts and circumstances of the case, the nature of the allegations, the duration of incarceration, the progress in the investigation, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two

- 4 - sureties for a like sum each to the satisfaction of the learned Principal Sessions Judge at Asifabad Kumuram Bheem-Asifabad District.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv.

However, the petitioner is directed not to interact with the victim or the witnesses in any manner. In case of any violation or inconvenience caused by the petitioner, the victim and the learned Additional Public Prosecutor are at liberty to file an application for cancellation of bail.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
