This petition is filed challenging the proceedings issued by the 2nd respondent vide proceedings No.K1/4834/2016, dated 16.04.2018, and to set side the same and for a consequential direction to the respondents to reinstate the petitioner into service with all consequential benefits. Learned counsel for the petitioner submits that the impugned suspension order pending enquiry is passed without application of mind by the respondents, since petitioner was already surrendered before the Commissioner of Tribal Welfare, T.S., Hyderabad; and as such question of interference with the enquiry does not arise. He further submits that the facts also does not warrant suspension of the petitioner pending enquiry; and that though the petitioner filed appeal against the same before the 1st respondent on 18.04.2018, the same is not being disposed of. Heard learned Assistant Government Pleader for Services.
Since the petitioner has already filed appeal before the 1st respondent, the writ petition is disposed of directing the 1st respondent to consider the appeal filed by the petitioner, in accordance with rules, within a period of four weeks from
the date of receipt of a copy of this order and take action accordingly. No order as to costs.
