THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Civil Revision Petition No.4346 of 2017 ORDER:

This revision under Section 151 of the Code of Civil Procedure, 1908, ('the Code') is filed by the petitioner/ J.Dr having been aggrieved of the order passed in E.P.No.262 of 2012 in O.S. no.289 of 2012 on the file of the Court of the Principal Senior Civil Judge, at Kothagudem, whereby, the General Manager, Singareni Collieries Company Limited, Rudrampur, is directed to hold a sum of Rs.3,27,728/ - from the salary of the judgment debtor in accordance with the provisions of Section 60 of the Code. 2.

At the hearing, learned counsel appearing for the petitioner submits that the judgment debtor retired from service and that therefore, no cause survives for adjudication in the revision, and the revision may be dismissed as infructuous reserving liberty to the judgment debtor to raise all available defences in the event the Decree Holder proceeds against the retirement benefits of the judgment debtor.

Recording the said submissions, the Civil Revision petition is dismissed as infructuous reserving liberty as aforesaid.

Miscellaneous petitions, if any, pending in this revision shall stand closed.
