HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.17230 OF 2018 ORDER: (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner has challenged the order dated 04.04.2018 passed in M.A.No.245 of 2018 in O.A.SR.No.987 of 2018 by the Andhra Pradesh Administrative Tribunal, Hyderabad.

2. It is not in dispute that the petitioner filed the aforesaid M.A seeking condonation of delay of 19 years 11 months 25 days in filing the proposed original application. It is also not in dispute that throughout her service career her date of birth was recorded as 01.07.1958 however she has approached the department just one year before the superannuation as per the aforesaid date of birth.

3. There is no explanation of such delay. Moreover vide G.O.Ms.No.165 Finance & Planning Department dated 21.04.1984 issued under Article 309 of the Constitution of India, every Government employee shall, within one month from the date on which he joints duty, makes a declaration as to his date of birth. However, the petitioner has not made any representation for correction of her date of birth and the same is continued as 01.07.1958, whereas the claim of the petitioner is 06.07.1959.

4. We find no ground to interfere with the impugned order dated 04.04.2018.

5. Finding no merit in the instant petition and the same is accordingly dismissed. There shall be no order as to costs. Miscellaneous Petitions, if any pending, shall stand closed.
