THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.5057 of 2005 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to issue a writ of mandamus, directing the respondents to release forthwith the withheld amount of Rs.59,500 (Rs.53,644 + Rs.5,856) as the said amounts were withheld from the gratuity payable to the petitioner without his consent.

2. The learned counsel for the petitioner seeks permission of this court to permit the petitioner to withdraw the writ petition with liberty to avail all the remedies available to him under law. Permission is granted.

3. Accordingly, the writ petition is dismissed as withdrawn. Miscellaneous petitions if any pending in this writ petition shall stand closed.
