HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Criminal Petition No.15277 of 2014 ORDER:

Heard both sides.

At the admission stage the following order is passed. Having regard to the prima facie accusation contained in FIR against the petitioners/accused, it is not a fit case to quash the proceedings. Hence, petitioners/accused shall face the trial and put-forth all the defences legally available to them before the trial Court for its consideration.

Considering the request of learned counsel for petitioners, A1 to A3 are directed to appear before the XIII Additional Chief Metropolitan Magistrate, Hyderabad on or before 18.04.2015 and on such appearance the trial Court shall recall NBWs issued against the petitioners/A1 to A3. Further, considering the submission of learned counsel for petitioners that petitioners/A2 and A3 are old aged persons and that A3 is suffering with heart problem, the attendance of A2 and A3 in C.C.No.56 of 2010 on the file of XIII Additional Chief Metropolitan Magistrate, Hyderabad is dispensed with except on the occasions when the trial Court requires their presence. Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
