HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16978 of 2015 ORDER:
Heard Sri N.Aswartha Narayana, learned counsel for the petitioner, and Sri G.Seshadri, learned Standing Counsel for respondent No.4.
Petitioners claim to be owners of different extents of lands in Sy.Nos.166, 167 and 168 of Koppalakonda Village, Garladinne Mandal, Anantapur District. Their grievance is that respondents are trying to dispossess them from the subject lands for laying road and constructing culvert from Kamalapuram to Penakacherla Dam culvert road without issuing notice and without following due process of law. Hence the writ petition.
As the petitioners claim to be the owners of the subject properties, it is well settled that the property rights of a citizen are protected under Article 300-A of the Constitution of India. Respondent - authorities, if require the subject properties for legitimate purpose, shall acquire by following due process of law.
In the circumstances, the Writ Petition is disposed of with a direction to respondents that the petitioners shall not be dispossessed from the subject lands and their possession shall not be interfered with except in accordance with law.
