HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.22201 of 2005 ORDER :

This writ petition is filed seeking Writ of Mandamus declaring the action of the respondents in not regularising the services of the petitioner as a Cleaner (Shramik) in the respondent Corporation inspite of possessing the requisite qualification as illegal, arbitrary and violative of Articles 14 and 16 of the Constitution of India and sought a consequential direction to the respondents to regularise the services of the petitioner as a Cleaner (Shramik).

The case of the petitioner is that he was initially engaged as a Casual Cleaner (Shramik) during 1984. The grievance of the petitioner is that the services of his juniors have been regularised, ignoring the case of the petitioner. Challenging the action of the respondents in not regularising his services as a Cleaner (Shramik), the petitioner has filed the present writ petition.

Heard Sri J.M. Naidu, learned counsel for the petitioner and Sri V.T.M. Prasad, learned Standing Counsel for the respondent Corporation.

Learned counsel for the petitioner contends that the petitioner is on the verge of retirement and he is likely to be retired in a few months. The learned counsel, therefore, submits that appropriate orders be passed directing the respondents to regularise the services of the petitioner as a Cleaner (Shramik) in the respondent Corporation. The learned Standing Counsel for the respondent Corporation submits that the case of the petitioner will be considered and appropriate orders would be passed in accordance with law, if not already passed.

Having considered the rival submissions of the learned counsel for the respective parties, this Court is of the considered view that this writ petition can be disposed of directing the respondents to consider the case of the petitioner for regularising his services as a Cleaner (Shramik), if not already regularised, by duly taking into account the fact that the petitioner was appointed as a Cleaner (Shramik) way back in the year 1984, and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order. It is needless to say that the petitioner is permitted to submit a fresh representation seeking regularisation of his services, if not already regularised.

With the above observations, this writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
