Prima facie from the reading of the order dated 30.07.2019 passed in I.A.No.1 of 2019 in W.P.No.10535 of 2019, it is seen that there is an inter se dispute between the petitioner and the 5th respondent in the writ petition. Therefore, the Court directed the 5th respondent not to stretch beyond the land to an extent of Ac.1.00 in Survey No.10. Similarly, petitioner was also directed not to interfere in land to an extent of Ac.1.00 in Survey No.10. The Court also observed that if there is any dispute regarding boundaries, it is always open to the petitioner and unofficial respondent No.5 to request the authorities concerned for conducting survey.

Learned counsel for the petitioner now contends that an application was made to conduct survey, but the exercise to conduct survey is not taken up, though there is direction by the Court. Further, pattadar passbook was issued to the 5th respondent in respect of land to an extent of Ac.1.00 in Survey No.10.

As noticed above, the direction was to the petitioner and the 5th respondent and there was no direction issued to the revenue authorities to conduct survey or not to issue pattadar passbook and title deeds. Therefore, it cannot be said that there is violation of the directions issued, much less deliberate and willful, warranting initiation of contempt proceedings.

At this stage, learned counsel for the petitioner informs the Court that the petitioner filed I.A.No.2 of 2019 in the writ petition praying to conduct survey of the subject land and the same is pending consideration.
