HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Writ Petition No.26 of 2010 ORDER:
In this writ petition, the petitioners seek a writ in the nature of Mandamus declaring the action of the 1st respondent in not taking action on the petitioners' representation dated 21.12.2009 and interfering with the civil litigation in respect of land in Sy.No.161-1, A, B, C, admeasuring Ac.2.66 cts. in Gudibanda Gram Polam, Gudibanda Mandal, Ananthapur District between the petitioners and 4th respondent as arbitrary and illegal and consequently direct the respondents not to dispossess the petitioners from the land in Sy.No.161-1, A, B, C, admeasuring Ac.2.66 cts. in Gudibanda Gram Polam, Gudibanda Mandal, Ananthapur District. 2) Learned Government Pleader for Home, on instructions, would submit that there is a civil dispute between the petitioners and 4th respondent with regard to landed property in Sy.No.161-1, A, B, C, admeasuring Ac.2.66 cts. in Gudibanda Gram Polam, Gudibanda Mandal, Ananthapur District and the respondents never interfered with the civil disputes of the petitioners herein.
3) In W.P.M.P.No.25 of 2010, this Court passed interim order dated 06.01.2010 directing respondents not to interfere with the possession of the petitioners in respect of the land in question without following due process of law.
3) Be that it may, in view of submission of learned Government Pleader that respondents-police never interfered with the possession of the
petitioners in respect of land in Sy.No.161-1, A, B, C, admeasuring an extent of Ac.2.66 cts. in Gudibanda Gram Polam, Gudibanda Mandal, Ananthapur District and also in view of the interim order, there is no need to pass any final order in the writ petition. 4) Accordingly, this Writ Petition is closed. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
