HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.40044 of 2014 ORDER:

Heard.

The petitioner has already approached civil court and obtained interim injunction against the defendants therein in the suit in O.S.No.434 of 2014 on the file of the Principal Junior Civil Judge, Ranga Reddy District. However, the said defendants are not parties to this writ petition. The petitioner subsequently filed a complaint alleging that the said defendants are threatening to grab her property. On the basis of the said complaint, the 3rd respondent has registered a case in Cr.No.837 of 2014 on 15-12-2014 and investigation is pending. The present writ petition is, however, filed by making an allegation that the 3rd respondent is not taking appropriate action against accused persons, who are interfering with the property of the petitioner.

The instructions received by the learned Government Pleader show that basing on the complaint of the petitioner, a case in Cr. No.837 of 2014 was registered on 15-12-2014 and recorded the statement of the complainant/petitioner. The 3rd respondent also addressed a letter to the Mandal Revenue Officer, Ghatkesar Mandal, Ranga Reddy District, requesting him to conduct survey and fix boundaries for the land claimed by the petitioner and the report of the Mandal Revenue Officer is awaited. The 3rd respondent also stated that he would take appropriate action against the accused basing on the outcome of the investigation. The instructions also refer to the injunction orders granted in favour of the petitioner by the civil court as referred to above.

In view of the aforesaid instructions, therefore, it is apparent that

the investigation into the petitioner's complaint is pending and after taking note of the injunction orders granted by the civil court, the 3rd respondent assures the court that he will take appropriate action against the accused by following due process of law and complete the investigation at the earliest.

Hence, the writ petition is disposed of directing the 3rd respondent to complete the investigation as early as possible and file appropriate report/charge-sheet before the jurisdictional court expeditiously preferably within four weeks from the date of receipt of a copy of this order. The petitioner is at liberty to approach civil court and seek police aid, if any police protection is required. No order as to costs.

The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
