THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.20759 OF 2016 ORDER:

Proceedings in Rc.No.170/2016-A dated 31.03.2016 passed by the 4th respondent appointing the 5th respondent as an authorized dealer on temporary basis in respect of Shop No.20 situated in Rajavolu Village, Cherukupalli Mandal, Guntur District, is challenged before this Court.

Heard the learned counsel for the petitioner as well as the learned Government Pleader for Civil Supplies. Main ground on which the challenge is laid is that the petitionerSociety was earlier appointed as temporary authorized dealer for distributing the scheduled commodities. However, without giving preference to petitioner-Society, the 5th respondent was appointed. Raising objection to the same, petitioner had made representation on 11.04.2016 and the same was not considered. Hence, the present writ petition.

Having considered the grievance of the petitioner as espoused in the writ petition, there being no vested right for the petitioner, the appointment made in favour of a Women's Group to encourage Dwakra Groups in terms of Policy of the State cannot be found fault with. At any rate, the appointment of 5th respondent is also on temporary basis. However, as and when a notification is issued for permanent appointment, petitioner shall also be at liberty to make application, which shall be considered by the respondent authorities on its own merits.

Subject to above observation, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions pending in the writ petition, if any, shall stand closed.
