THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO C.M.A.No.413 of 2010 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This appeal is filed against the order and decree, dated 11.03.2010, in O.P.No.38 of 2007 passed by the learned Senior Civil Judge, Nizamabad, whereby the petition filed by the respondent-husband against the appellant-wife under Section 13 (1) (ia) of the Hindu Marriage Act, 1955, for grant of decree of divorce, was allowed.

In this appeal, a memo, signed by the counsel for the appellant, is filed on behalf of the appellant, seeking to refer the appeal to Legal Services Authority/Lok Adalath for recording compromise. However, today when the matter is called for hearing, learned counsel for the appellant submitted that he received instructions from his client to withdraw the appeal as the respondent agreed to pay Rs.3,50,000/-, which is kept with the mediator, to his client after withdrawing of this appeal.

In view of the above, the appeal is dismissed as withdrawn. No order as to costs.

As a sequel, interim order, dated 02.06.2010, is vacated and CMAMP.No.1082 of 2010 shall stand closed. ____________________________ JUSTICE R. SUBHASH REDDY
