HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.1503 OF 2015 ORDER:

The grievance of the petitioners is that they are all beneficiaries of house site pattas granted by the Government vide H.S.Dis.No.6/1416, dated 02.05.2007, and the respondent authorities are threatening to dispossess them without following due process. It is specific contention of the learned counsel for the petitioners that house site pattas granted in their favour are still in force and in that view of the matter, petitioners' possession and enjoyment of the properties cannot be interfered with. Notice before admission was ordered in this matter and on instructions learned Assistant Government Pleader for Revenue (A.P.) submits that petitioners and other beneficiaries have suppressed the fact that they have been issued notice on 25.11.2014 as to why the house site pattas shall not be cancelled and resume the land to the Government for violation of the conditions of house site pattas, as some of the petitioners have not occupied the sites and not taken up any constructions in the sites. He further submits that the enquiry is going on, necessary orders would be passed in due course.

Having considered the rival submissions, it is clear that as on today, the pattas granted in favour of the petitioners have not been cancelled and no final orders as such, cancelling the pattas granted in favour the petitioners, are granted. In that view of the matter, leaving it open to the petitioners, the Writ Petition is disposed of giving liberty to the petitioners to file their objections to the show cause notice said to have been

issued to them raising the objections. On filing of such objections, the respondent authorities shall consider the same and pass orders. It is made clear, till such time the orders are passed, the pattas granted in favour of the petitioners are in existence and they are entitled to the benefits of pattas granted in their favour. There shall be no order as to costs.

Miscellaneous petitions, if any pending, in this Writ Petition shall stand closed.
