CVNR, J & GSP, J WA.Nos.839 & 840 of 2016 Dt:14.9.2016 COMMON JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) These two Writ Appeals arise out of common order, dated 27.6.2016, in Writ Petition Nos.4877 and 25528 of 2015. During the hearing, Mr. K.G.Krishna Murthy, learned senior counsel appearing for the appellant, sought to raise a ground which was not specifically taken before the learned single Judge, viz., that the appellant was appointed against one of the two vacancies reserved for S.T. women and that, if the roster points are followed, she will be entitled to be appointed as of right even if she does not have B.Ed qualification. He has fairly conceded that this point was not raised before the learned single Judge.

In our opinion, in a letters patent appeal, it is not appropriate for us to consider a point which was not specifically raised and argued before the learned single Judge. Learned senior counsel has, therefore, sought for permission of the Court to withdraw the Writ Appeals with liberty to his client to file a Review Petition before the learned single Judge.

Accordingly, without expressing any opinion on the merits of the case, the Writ Appeals are dismissed as withdrawn with liberty to the appellant in terms of the prayer made.

CVNR, J & GSP, J WA.Nos.839 & 840 of 2016 Dt:14.9.2016 As a sequel to dismissal of the Writ Appeals, WAMP.Nos.2017 and 7018 of 2016 filed by the appellants for interim relief are dismissed as infructuous.
