This writ petition is filed for the following relief; "... to pass an order or orders one in the nature of Writ of Mandamus declaring the action of respondent No.4 in not taking any further investigation against the respondent Nos.5 to 7 inspite of crime registered in FIR No.85 of 2018 of P.S., Kammarapally, dated 12.09.2018, under Sec.447, 427 & 506 IPC as arbitrary, illegal, unconstitutional, unwarranted and uncalled for and in violation of Article 14 and 21 of the Constitution of India and consequently direct the respondent police to consider the complaint of the petitioner dt.12.09.2018 by filing the charge sheet in FIR No.85 of 2018 of P.S., Kammarapally in the interest of justice and pass such other order or orders as this Hon'ble Court may deem fit in the circumstances of the case."
Learned Assistant Government Pleader for Home produced written instructions dt.07.09.2019 submitted by the Asst.Commissioner of Police, Armoor, Nizamabad District, wherein it is stated that after registering the petitioner's case in Crime No.85 of 2018 the same was investigated into and found to be civil in nature; that the investigating officer addressed a letter to the Asst.Commissioner of Police, Armoor to accord permission to refer the case as Civil in nature, upon which the Asst.Commissioner of Police has also accorded permission; that thereafter the investigating officer served a notice to the petitioner on 06.09.2019 informing him that the case is referred as civil in nature; and that a final report has
also been filed before the Addl.Judicial First Class Magistrate, Armoor on 06.09.2019.
A copy of the final report was also served on the learned counsel for the petitioner.
In view of the aforesaid written instructions, recording the same, the writ petition is disposed of granting liberty to the petitioner to avail alternate remedy as may be available to her under law. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
