THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.26285 OF 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Writ Petition is filed seeking to declare the action of respondent No.3, in providing 1% reservation for admission into M.B.B.S. Course only for the children of Ex-Servicemen and Servicemen categories in the CAP (Army), as illegal and arbitrary and consequently, to direct the respondents to admit the petitioner under 1% reservation of Ex-Servicemen and Servicemen of Defence quota.

Father of the petitioner is working as Superintendent in stores department of Indian Navy at Naval Store, Visakhapatnam. Petitioner, after completion of her intermediate, has appeared for EAMCET- 2015 and secured 34322 rank.

In this Writ Petition, it is the grievance of the petitioner that as Servicemen and Ex-servicemen are provided 1% reservation and as her father was appointed in the common pool of recruitment in Indian Navy, there is no reason to deny reservation to her.

Ex-servicemen and Servicemen in the Defence Services i.e., Army, Air Force and Navy constitute a different class for the purpose of effecting reservation and having regard to the nature of duties entrusted to them, reservation of 1% is provided to them. As the father of petitioner is working as Superintendent in stores department of Indian Navy, he cannot be compared with those working in Defence Services i.e., Army, Air Force or Navy. In that view of the matter, we do not find any merit in this Writ Petition for grant of directions as prayed for. Accordingly, the Writ Petition is dismissed.

Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
