THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.7293 OF 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) Learned counsel for the respondent Municipal Corporation submits that he does not want to file counter affidavit. We are of the view that the matter can be disposed of by the following order.

It would be open for the petitioner to make a representation to the demand made recently by the Municipal Corporation and such representation shall be considered by the Corporation and appropriate order shall be passed in accordance with law within a period of six weeks from the date of communication of this order, obviously after giving opportunity of hearing to the petitioner. Till such decision is taken, no coercive measures shall be taken. In spite of notice of hearing being served, if the writ petitioner does not turn up, then nothing is to be done by the Municipal Corporation. It would be open for the Municipal Corporation to recover the tax in accordance with law in relation to the dues which were subject matter of the appeal, which was withdrawn subsequently.

The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
