THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 19192 of 2019 ORDER:

In this writ petition, grievance of petitioner is that the respondent authorities are not considering his request for shifting of toddy shop run by the sixth respondent to the premises in Survey No.774/4, as it is located within 100 meters from Jankampet Mahalakshmi Temple.

At the hearing, learned Government Pleader produced before this Court the written instructions dated 04.09.2019 issued by the District Prohibition and Excise Officer, Nizamabad, and stated that considering the request of the sixth respondent, who has been granted TFT licence in 2017, as his licence is valid till 30.09.2022 and on account of the no objection granted by the Gram Panchayat vide letter dated 12.10.2018, the toddy shop was permitted to be shifted to the outskirts of Jankampet Village, Yedpalli Mandal, and that Jankampet Mahalakshmi Temple is 100 meters away from the toddy shop in question and the same has been certified by the Assistant Commissioner of Endowments Department, Nizamabad. The said instructions are placed on record.

CKR, J W.P.No.19192 of 2019 In view of the above and inasmuch as the petitioner had not challenged the licence granted in favour of the sixth respondent, the writ petition is closed by giving liberty to the petitioner to challenge the licence granted in favour of the sixth respondent as well as the permission granted to the sixth respondent to shift his toddy shop to the subject premises.

Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
