THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10464 of 2016 ORDER:

Heard Sri M. Dhananjay Reddy, learned counsel for the petitioners, and Sri Pasam Krishna Reddy, learned Standing Counsel for the Greater Hyderabad Municipal Corporation. The prayer of the petitioners in this case is as under: "It is therefore prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order or direction particularly a Writ in the nature of Mandamus declaring the inaction of the respondents 1 & 2 herein in granting the building permission over plotted area admeasuring an extent of 2166 Sq.yds in Plot No.61 forming part of Sy.No.7, Ward No.11, Block No.13, situated at Saroornagar Village & Mandal, Ranga Reddy District as illegal, arbitrary and violative of Article 14 and 19(1)(g) and 21 of the Constitution of India and consequently direct the respondents 1 & 2 herein to grant the building permission to the petitioners over the said plot forthwith and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Sri Pasam Krishna Reddy, learned Standing Counsel, stated that the petitioners' application for building permission is kept pending owing to certain objections having been raised by third parties. Even if so, it is for the municipal authorities to consider such objections in accordance with law and take appropriate action thereon. They cannot keep the petitioners' application pending indefinitely on such a ground.

The writ petition is accordingly disposed of directing the municipal authorities to consider and dispose of the building permission application filed by the petitioners expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall stand closed in
