THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.41622 of 2015 ORDER: (Per Justice Sanjay Kumar) This writ petition was filed assailing the auction notice dated 23.11.2015 issued by the Bank of India proposing to put to sale the secured asset belonging to the petitioner on 28.12.2015. Smt. T. Vidya Rani, learned counsel for the Bank of India, would inform this Court that the auction sale held on 28.12.2015 did not materialize and that the property was thereafter brought to sale successfully under a separate auction notice. That being so, challenge to the auction notice dated 23.11.2015 is rendered purely academic and does not warrant consideration on merits. The writ petition is accordingly dismissed.

Interim order dated 22.12.2015 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
