2017-03-28Challa Kodanda Ram1 pages

THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.11074 OF 2017 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents for not considering the application of the petitioners' firm for grant of mining lease for quartz and field spar on 28.12.2015, as illegal and arbitrary and consequently direct the respondents to forthwith consider the application of the petitioners.

Heard and perused the material available on record. It is the specific contention of the learned counsel for the petitioners that the petitioners have made an application as far back as on 28.12.2015 for grant of mining lease, and the respective authorities have already processed the same, however, awaiting the final decision of the 2nd respondent.

Considering the limited grievance of the petitioners, the writ petition can be disposed of with a direction to the 2nd respondent to pass appropriate orders on the application made by the petitioners, within a specific time.

Accordingly, the Writ Petition is disposed of directing the 2nd respondent to pass appropriate orders on the application, dated 28.12.2015, made by the petitioners, within a period of eight (8) weeks from the date of receipt of a copy of this order. No order as to costs. As a sequel, miscellaneous petition pending if any, shall stand closed. _____________________ CHALLA KODANDA RAM, J March 28, 2017 KTL
