THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.9665 of 2012 ORDER:

This Writ Petition was filed challenging the highhanded action of respondent Nos.3 to 5 in attempting to demolish the part of petitioner's tiled house bearing No.3-37, Main Road, Rudravaram Village, SN Padu Mandal in Prakasam District, without following any law. This Court, by order dated 04.04.2012, granted stay of demolition, except in accordance with law.

Though this Court dismissed W.V.M.P.No.3523 of 2012 on 05.11.2015, another vacate petition is filed now in W.V.M.P.No.55 of 2016 by respondent Nos.2 to 4 stating that the CC road to a width of 5.5 metres is constructed at the petitioner's house without making any attempt to demolish the house in order to facilitate free flow of traffic and, on the other hand, on the remaining road length of Rudravaram Village and other three villages the CC road is laid along with shoulders of 1.0 metre either side. The respondents orally informed the petitioner about the widening of the road and the extent of availability of R&B road. The petitioner gave an undertaking on 28.03.2012 to demolish voluntarily the compound wall in order to facilitate the widening of R&B road. In view of the undertaking given by the petitioner himself on 28.03.

2012, this Writ Petition is closed, as the petitioner himself wanted to demolish the wall of the house and reconstruct the same in order to facilitate the widening of the R&B road. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
