THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.5084 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of Cr.P.C., seeking pre-arrest bail to the petitioner/accused No.2 in the event of his arrest in connection with Crime No.35 of 2022, pending on the file of Humayunnagar Police Station, Hyderabad, registered for the offences punishable under Section 307 read with 34 of Indian Penal Code and Section 25(1)(A) of Indian Arms Act. 2.

Heard learned counsel for the petitioner/accused No.2 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that on 13.02.2022, the de facto complainant filed written complaint stating that her husband by name Mohd.Mahaboob Qureshi has taken a shop on rent for running a mutton shop fifteen days prior to the present complaint. On 13.02.2022 at about 8-00 A.M., two persons came to the shop and one of them stabbed her husband with a knife and as her husband received serious injuries, she has taken him to Premier Hospital for treatment. She also named this petitioner and accused No.1, who was arrested on 15.02.2022. As seen from the Remand Report, the Police

have recovered the knife and also blood stained clothes at the instance of accused No.1.

The name of this petitioner is specifically mentioned as accused No.2 by the de facto complainant. The Police arrested accused No.1 and at his instance, knife was recovered. The petitioner, who is accused No.2, can be granted Anticipatory Bail, as custodial interrogation would not be necessary in the present circumstances of the case, on the following conditions:

1) The petitioner/accused No.2 is directed to surrender before the Station House Officer, Humayunnagar Police Station, Hyderabad, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/accused No.2 on bail, on his executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to his satisfaction.

2) On such release, the petitioner/accused No.2 shall report before the said Station House Officer on every Monday between 10.00 a.m. and 5.00 p.m., for a period of three months or till filing of the charge sheet, whichever is earlier.

3) The petitioner/accused No.2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
