HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.34831 OF 2016 ORDER:

Heard Mr.K.Bhaskara Rao for petitioner and Assistant Government Pleader for Panchayat Raj for respondents. The petitioner challenges show cause notice dated 29.08.2016 and the action of respondents 3 and 4 in taking away the records pertaining to Bondapalli Gram Panchayat i.e. (i) Minutes Book, (2) Agenda Book, (3) Cash Book and (4) Cheque Book on 27.08.2016, as illegal and without jurisdiction. The case of petitioner is that respondent No.3, in the absence of petitioner, visited the Bondapalli Gram Panchayat and taken away the records. Further, respondent No.3 issued show cause notice dated 29.08.2016. Though explanation to the show cause notice was given on 09.09.2016, no action has been taken so far. After perusing the record, this Court is of the view that the petitioner can make fresh explanation/ representation to 3rd respondent, who in turn will consider the representation of petitioner and also the extant guidelines issued by the Government and take appropriate decision.

Having regard to the above circumstances, the writ petition is disposed of by this order.

The petitioner is given one week time from today to resubmit explanation to the proceedings dated 29.08.2016. The 3rd respondent is directed to consider and pass final orders on the

explanation/ representation in the backdrop of proceedings dated 29-08-2016 within two weeks from the date of receipt of a copy of this order.

The writ petition is disposed of accordingly. No order as to costs.
