THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12170 OF 2011 ORDER:

This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the Commissioner, Guntur Municipal Corporation, Guntur District2nd respondent in not considering the representation dated 7-3-2011 made by the petitioner for allotment of shop in 24 shops adjacent to Dr.Kolli Sharada Wholesale Vegetable Market, Guntur, as being illegal, arbitrary and for issuance of appropriate consequential directions.

2. This Court by order dated 26-04-2011, while issuing rule nisi, granted interim direction to the respondents to proceed with the allotment of the shops in question strictly in accordance with the terms and conditions prescribed in the notification dated 24-02-2011.

3. It is now stated by learned Standing Counsel for the 2nd respondentCorporation that pursuant to the interim direction passed by this Court, the case of the petitioner was considered along with other eligible persons, but the name of the petitioner could not figure in the list of beneficiaries, conducted through lottery system. Inasmuch as the case of the petitioner was considered for allotment of shop in question, the relief sought in the writ petition worked out by way of the interim direction granted by this Court. Hence, the writ petition is disposed of making the interim order as final order in the writ petition. Miscellaneous petitions, if any, pending in this Writ Petition shall stand disposed of. No order as to costs.
