HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION No.2010 of 2011 ORDER:

Heard Mr.Venkat for revision petitioner. In spite of service of notice, none appears for respondents.

The revision is filed under Article 227 of the Constitution of India.

The issue arises under the Provincial Insolvency Act. The revision petitioner challenges the order of Official Receiver dated 10.03.2011.

Learned counsel for petitioner submits that at the first instance the revision petitioner is required to avail the remedy of statutory appeal under Section 68 of Provincial Insolvency Act and thereafter approach this Court either by way of further appeal or revision.

I have perused the order, dated 10.03.2011, and keeping in view the remedy of statutory appeal, the revision is disposed of by this order.

(a) The petitioner is given liberty to file appeal along with an application to condone the delay within thirty days from today by enclosing a c opy of this order.

(b) Learned Senior Civil Judge considers the request of petitioner for condonation of delay, by

keeping in view the time spent by revision petitioner in working out the remedy under Article 227 of the Constitution of India by filing the instant Civil Revision Petition.

(c ) The appellate Court considers and disposes of the appeal as expeditiously as possible preferably within six months from the date of filing of appeal. (d) The interim order is in force from 10.06.2011. This Court directs continuation of interim order dated 10.06.2011 for a period of six weeks from today and gives liberty to the petitioner to obtain orders, as are necessary in the appeal, the petitioner files before appellate Court.

Miscellaneous petitions, if any, shall stand closed. No order as to costs.
