THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.16530 OF 2013 ORDER:

Heard the learned counsel for the petitioner as well as the learned GP appearing for respondent No. 1 and the learned counsel appearing for respondent Nos. 2 and 5. 2.
The prayer sought in the Writ Petition is as under: " ....issue an order or orders or direction or writ more particularly in the nature of Mandamus declaring the action of the Respondent No. 1 in not taking appropriate action for not investigating the Crime against the Respondents No. 2 to 7/ Accused No. 1 to 6 in Crime No. 141 of 2012 on the file of the Judicial First Class Magistrate at Tandur, Ranga Reddy District as illegal, arbitrary, unconstitutional, null and void, consequently direct the respondent No.1 to take steps by making effective proper investigation, file charge sheet and such other all further steps as per law."

During the course of hearing, it is brought to the notice of this Court that respondent Nos. 2 and 5 have filed Criminal Petition Nos. 8297 of 2014 and 9329 of 2014 respectively to quash the proceedings initiated against them in Cr.No.141 of 2012 and obtained stay of all further proceedings.

Learned GP appearing on behalf of respondent No.1 would submit that in view of the interim orders passed in the above said two Criminal Petitions, respondent Police is not able to investigate and file a report. It is further brought to the notice of this Court that the learned counsel for the petitioner has already filed vacate stay petitions in the said Criminal Petitions.

In view of the above, this Court is of the opinion that no further orders are required in the Writ Petition.

Accordingly, the Writ Petition is closed.

It is needless to observe that the closure of the present Writ Petition will not prejudice the rights of the petitioner to agitate all the grounds available to him in the above said two Criminal Petitions filed by respondent Nos. 2 and 5.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
