THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.27427 OF 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ, order or direction, more particularly a writ in the nature of Writ of MANDAMUS declaring the action of the 1st respondent i.e., the Collector and District Magistrate, Vizianagaram District, Vizianagaram in not issuing notification notifying Salur, Belagam and Pachipenta Hill Jamindars as Members belonging to the Konda Dora Caste Scheduled Tribe community on par with Kurupam and Merangi Hill Jamindars, as bad, illegal, arbitrary, opposed to law and pass such other order or orders as the Hon'ble Court may deem fit and proper."

2. Heard Sri M.Vidyasagar, learned counsel appearing for the petitioner and Learned Government Pleader for Social Welfare and Revenue appearing for the respondents.

In the course of hearing, it is submitted by the learned counsel for the petitioner herein that for redressal of the grievance of the petitioner, a representation was submitted to the Collector and District Magistrate, Vizianagaram District, Vizianagaram - 1st respondent herein, on 24.03.2013 and the same is still pending. Learned counsel for the petitioner has requested this court to direct the 1st respondent herein to take appropriate action on the said representation.

4. This court considers the said request as reasonable and the said reason is not opposed by the learned Government Pleader. In view of the above, without expressing any opinion on the merits writ petition is disposed of, directing the 1st respondent - Collector and District Magistrate, Vizianagaram District, to pass appropriate orders on the representation dated 24.03.2013, said to have been submitted by the petitioner herein, within a period of three months from the date of receipt of copy of this order.

6. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. _________________ A.V.SESHA SAI,J 10th September, 2015 ss
