THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.7036 of 2016 ORDER:

Petitioners' grievance is that petitioners have approached the 5th respondent for registration of certain documents, but the 5th respondent refused to receive the same unless No Objection Certificate is issued by 6th respondent.

2. Learned counsel for petitioners states that no order in writing has been issued by 5th respondent refusing to receive the documents.

3. Learned Government Pleader for Revenue representing 5th respondent as well as Sri S.Arifullah, learned Standing Counsel for 6th respondent state that there is no evidence that the petitioners have presented the documents for registration and it was refused by 5th respondent on the ground that No Objection Certificate from 6th respondent was not produced by petitioners.

4. Learned counsel for petitioners refuted the same and states that 5th respondent simply refused to entertain the documents without passing any order.

5. In view of the respective submissions, the Writ Petition is disposed of directing the petitioners to present the documents, which they wish to be registered, before the 5th respondent

within two (02) weeks from the date of receipt of a copy of this order. The 5th respondent shall receive the same and if does not wish to register the same, he shall pass an order under Section 71 of the Registration Act, 1908 (for short "the Act") that he does not wish to register them and communicate the said decision to petitioners within six (06) weeks from the date of presentation of the documents by petitioners. Before passing the said order, the objection of 6th respondent shall also be considered. No costs.

6. As a sequel, miscellaneous petitions pending if any, in this Writ Petition shall stand closed.
