HON'BLE SRI JUSTICE S.V. BHATT W.P.No. 23031 of 2013 O R D E R:- No representation for the petitioner.

Heard the learned Assistant Government Pleader for Home.

The writ prayer reads as under:

" ...writ of Mandamus to declare the action of the respondents in not taking action on the complaint given by the petitioner on 15.04.2013, as illegal, arbitrary and contrary to the provisions of Cr.P.C."

The Assistant Government Pleader submits that the police, after taking note of the allegations in the complaint, were of the view that cognizable offence is not made out. Further, a civil suit is pending between the petitioner and the 4th respondent, therefore, crime is not registered. It is further stated that the petitioner was also informed on the same lines.

In view of these circumstances, this Court is of the view that the petitioner is not interested in pursuing the writ prayer.

The writ petition is dismissed for default. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
