THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE N. BALAYOGI WRIT PETITION No. 35211 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed by the Union of India and its postal authorities assailing the order dated 20.10.2014 passed by the Central Administrative Tribunal, Hyderabad Bench, in O.A.No.523 of 2013.

By the said order, the Tribunal disposed of the O.A. directing the authorities to modify/revise the Department of Post Junior Engineer (Civil) in Civil Wing Rules, 1995 in respect of Junior Draughtsman (Civil) post in terms of the Office Memorandum dated 24.03.2009 of the Department of Personnel and Training of the Central Government, and to consider the case of the first respondent herein, the applicant in the O.A., as early as possible but not beyond six months.

By order dated 20.10.2016, this Court granted interim stay of the operation of the Tribunal's order.

While so, it is now brought to the notice of this Court by Dr. P.B. Vijaya Kumar, learned counsel for the first respondent, that the Government of India amended the Rules as directed by the Tribunal and communication dated 22.11.2016 was also addressed to the learned Assistant Solicitor General informing him that the case of the first respondent would be considered as and when a promotional vacancy gets generated in future. In the light of the aforestated developments, the cause in this writ petition does not survive for consideration on merits.

The Writ Petition is accordingly dismissed. Interim order dated 20.10.2016 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs. ______________________ SANJAY KUMAR, J Date: 28.02.2017 ______________________ N. BALAYOGI, J va
