THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.35919 OF 2015 ORDER:

The only grievance of the petitioners is that the objections filed on 08.09.2015 before the District Collector, Tahsilar and the Revenue Divisional Officer, Narayanpet, Mahabubnagar District, objecting for issuance of pattdar passbooks and title deeds in favour of only one of the legal heirs of the deceased pattadar are not being considered.

Learned Government Pleader for Revenue submitted written instructions along with copy of the Endorsement, dated 26.10.2015 already issued to the petitioners. Learned counsel for the petitioners has also been served copy of the said Endorsement. In the said endorsement, the 2nd respondent has informed the 1st petitioner that since the mutation was affected in the name of one Md.Saleem Pasha, legal heir of late Shaik Mehboob Pasha with the consent of all the legal heirs of deceased Shaik Mehboob Pasha including the petitioner, the petitioners' application cannot be considered since orders were already passed in the recent Endorsement. Therefore, nothing survives in the Writ Petition. The Writ Petition is disposed of with liberty to the petitioners to take further legal proceedings, if they are aggrieved by the said Endorsement and the contentions raised in this writ petition are accordingly left open. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
