THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.28296 of 2015 ORDER :

The petitioner was elected as Sarpanch of Chatragadda Gram Panchayat, Repalle Mandal, Guntur District. On the allegation of committing serious irregularities in the administration of Gram Panchayat, the District Panchayat Officer, Guntur (3rd respondent) issued a show cause notice dated 30.06.2015 calling upon the petitioner to submit her explanation. Pending enquiry of the allegation, in exercise of power vested in him under Rule 42 (1) of the Rules notified vide G.O.Ms.No.30 dated 20.01.1995, the power to withdraw the funds of Gram Panchayat vested in the petitioner was suspended. The case of the petitioner is that in response to the said show cause notice, a reply was given on 13.07.2015. But so far no orders are passed. On the contrary, the power to withdraw the funds of Gram Panchayat vested in the petitioner-Sarpanch remains suspended.

2. Having regard to the fact that explanation is already submitted by the petitioner, it is suffice, if the writ petition is disposed of, directing the 3rd respondent to consider the explanation submitted by the petitioner, afford

personal hearing intimating the date of personal hearing in advance and after considering the explanation and submissions, pass appropriate orders as warranted by law as expeditiously as possible, preferably within a period of four weeks from the date of receipt of copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
