ORDER:

This Writ Petition is filed for a Mandamus to direct respondent No.2 not to fill the vacancy in respect of Fair Price Shop No.77 of Butchirajupalem, Circle-I, Visakhapatnam City on permanent basis and to direct the respondents to consider the petitioner's case for appointment as fair price shop dealer as the legal representative of his deceased father, who was a permanent fair price shop dealer. At the hearing, learned Assistant Government Pleader for Civil Supplies (Andhra Pradesh) submitted that the State Government has issued G.O.Ms.No.4, dated 28.02.2014, providing for compassionate appointment to one of the family members of the deceased permanent fair price shop dealers, subject to their satisfying the eligibility criteria stipulated therein. He has further stated that the vacancy of the subject fair price shop has not been filled up on permanent basis so far.

In the light of the above mentioned G.O., respondent No.2 is directed to consider the claim of the petitioner for appointment as permanent fair price shop dealer in place of his deceased father, subject to his satisfying the eligibility criteria laid down in the said G.O. and communicate his decision to the petitioner within one month from the date of receipt of a copy of this order.

Subject to the above direction, the Writ Petition is disposed of.
