HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.6856 of 2016 ORDER:- The petition is filed by petitioners/A.3 and A.4 to quash the order dated 20-04-2016 passed in Crl.M.P.No.674 of 2016 in C.C.No.13 of 2009 on the file of Principal Special Judge for CBI Cases, Hyderabad, by and under which, the learned Judge has dismissed the petition filed under Section 91 Cr.P.C., for directing the bank authorities of State Bank of Bikaner and Jaipur, Shivaji Nagar Branch, Secunderabad, to produce the statement of account of petitioner/A.4.

The petitioners/A.3 and A.4 along with other accused are facing trial for the charges punishable under Sections 120-B, 419, 420, 468 and 471 I.P.C., and Section 13 (2) read with 13 (1)(d) of P.C.Act.

The specific contention of the petitioners/A.3 and A.4 is that there are certain transactions of petitioner/A.4 company which would support their defence and therefore the statement of account may be called for.

Taking into consideration the totality of the facts and circumstances of the case, I feel that necessary direction can be issued to the State Bank of Bikaner and Jaipur, Shivaji Nagar Branch, Secunderabad, to produce the statement of account of the petitioner/A.4 and on process being deposited by petitioners/A.3 and A.4, summons should issue to the Branch Manager, State Bank of Bikaner and Jaipur, Shivaji Nagar Branch, Secunderabad, to cause production of the statement of account in respect of account bearing Nos.51016183758

and 51016183769. The trial Court is further directed to see that the said statement of account is produced before it by 30.06.2016.

With the above direction, the Criminal Petition is allowed. Miscellaneous petitions, if any, shall stand closed.
