HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE MS.JUSTICE J. UMA DEVI WRIT PETITION No.16807 OF 2018 ORDER: (per V. Ramasubramanian, J) What is challenged in the writ petition is an impossible condition imposed by the Debts Recovery Tribunal in the impugned order.
2. Heard Mr.D.Raghavulu, learned counsel for the petitioner. Mr.B.S.Prasad, learned Standing Counsel takes notice for the Bank.
3. Though the first installment of 15% was directed to be deposited on 23.04.2018 itself, the petitioner has paid the first installment on 24.04.2018. The second installment shall be deposited on or before the 10th day of May 2018. Upon such deposit being made, the order of the Tribunal will stand modified to the said extent. If compliance is not made, it will be open to the Bank to proceed further.
4. The writ petition is disposed of accordingly. As a sequel thereto, miscellaneous petitions, if any, pending shall stand dismissed. No order as to costs.
