ORDER:

This writ petition is filed for a mandamus to set aside proceedings in Rc.No.4366/2012-13/C/Dt.17.11.2012 of respondent No.2, whereby he has suspended the petitioner's fair price shop authorization. By order, dated 28.11.2012, this Court suspended the impugned proceedings.

At the hearing, learned Assistant Government Pleader for Civil Supplies (AP), on instructions, submitted that in pursuance of the interim order passed by this Court, the petitioner is being continued as the fair price shop dealer and that the enquiry initiated against her is still pending. Inasmuch as more than 21⁄2 years had elapsed from the time of suspension of the impugned proceedings and the petitioner is being continued on the strength of such interim order, it is in the interests of justice that the petitioner shall be continued till the enquiry is completed and final order is passed by respondent No.2.

Accordingly, impugned proceedings, dated 17.11.2012, of respondent No.2, are set aside and respondent No.2 is directed to complete the enquiry, pass a final order and communicate the same to the petitioner. Till respondent No.2 completes the enquiry and passes a final order, the petitioner shall be continued as the fair price shop dealer. The Writ Petition is accordingly disposed of. As a sequel to the disposal of the Writ Petition, W.P.M.P.No.46508 of 2012 filed by the petitioner for interim relief shall stand disposed of. __________________________ C.V.NAGARJUNA REDDY, J 13th August, 2015
