THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Contempt Case No.2263 of 2013 ORDER:

The order, violation of which is alleged in this contempt case, is the order passed by this Court in W.P.No.20255 of 2013 dated 12.07.2013 whereby the 3rd respondent (Thasildar) was directed to consider the petitioner's application for grant of pattadar pass books and title deeds in accordance with law, pass necessary orders and communicate the same to the petitioner within a period of two months from the date of receipt of a copy of the order. By endorsement dated 20.11.2013, the Tahsildar informed the petitioner that a case was pending in O.S.No.1047 of 2011 and, consequently, pattadar pass books cannot be issued in view of Section 8(2) of the Act and Rule 9 of the Rules.

Learned Government Pleader for Revenue would submit that the suit in O.S.No.1047 of 2011 has subsequently been decreed in favour of the petitioner and, after he obtains possession of the subject land, any application made by him for grant of pattadar pass books would be considered in accordance with law.

It is evident from the endorsement dated 20.11.2013 that the petitioner's application has been considered and rejected. As such, the order of this Court cannot be said to have been violated, much less, wilfully and deliberately. I see no reason, therefore, to proceed against the respondents under the Contempt of Courts Act.

The Contempt Case is, accordingly, closed. The Contempt Applications, pending, if any, shall also stand closed. There shall be no order as to costs. ______________________________ RAMESH RANGANATHAN, J 18th December 2015.
