HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.29201 OF 2017 ORDER:
This writ petition is filed challenging the proceedings dated 23-08-2017 transferring the petitioner from Rajahmundry to Vizinagaram Zonal Workshop, Vizianagaram.
Learned counsel for the petitioner submits that impugned order is passed without notice and without any basis. He submits that the petitioner never misbehaved with any one and he is sincere in duties and serving respondent-Corporation with dedication.
On the other hand, Sri S.V.Ramana, learned counsel appearing for the respondent-Corporation produced proceedings dated 08-08-2017, which goes to show that complaints have been filed against the petitioner and serious allegations are made against the petitioner and a preliminary enquiry was also conducted and basing on the same, following facts came to light:
1. he is acting as an evangelist to Christian missionary in the working place.
2. Doing panchayat/settlements in the Security branch.
3. Encouraging false complaints by him caste people against employees and others.
4. Un-authorisedly collecting money for release of MVI seized vehicles.
5. Collecting money when he goes for enquiries for example Bread winner enquiry.
6. Actively participating in caste activities.
7. Threatening workers & Co-employees.
8. In-subordination.
He also placed letter dated 21-08-2017 issued by the Director, (V&S), A.P.S.R.T.C., Vijayawada, to the Vigilance and
Security Officer, APSRTC, Vizianagaram Zone, Visakhapatnam to initiate disciplinary action basing on the enquiry report of Vigilance & Security Officer, Visakhapatnam. The above said letter addressed by Director to the Vigilance & Security officer also goes to show that a decision is taken to initiate disciplinary proceedings against the petitioner. Serious allegations are made against the petitioner. The truth or otherwise of allegations can be gone into the enquiry and not at this stage.
In view of the same, this Court is not inclined to interfere with the order of transfer at this stage.
Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
