ORDER

This writ petition is filed seeking to declare the action of respondents in not considering the application of petitioner for extension of parole period, as arbitrary and illegal and to direct the respondents to extend the parole for further period of six months i.e., from 21.04.2016 to 21.10.2016.

Heard learned counsel for petitioner and learned Government Pleader for Home.

Admittedly, petitioner is on parole as per the orders of this Court in W.P.No.36591 of 2015 dated 09.11.2015. Since his parole period is coming to an end, petitioner made a representation dated 02.04.2016 to the first respondent seeking extension for a period of six months from 21.04.2016 to 21.10.2016, but the same has not been considered. Hence, the present writ petition is filed. 4.

Considering the facts and circumstances of the case, the first respondent is directed to consider the petitioner's application dated 02.04.2016 and pass appropriate orders on or before 18.11.2016. Till then, petitioner shall not be sent to prison. 5.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________________ JUSTICE RAJA ELANGO 24th October, 2016 sj
