THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.27204 of 2009 ORDER:
The petitioner prays for the following relief :- ".... to issue writ, order or direction more particularly in the nature of Writ of Mandamus, directing the 1st respondent to take action against the 3rd respondent's College for non payment of Salary to the petitioner from 03.03.2008, (the date on which the petitioner was deemed to be reinstated) to 08-12-2008 (the date on which the petitioner was reinstated/ permitted to work) with all consequential arrears by holding that the impugned action of the respondents is illegal and arbitrary...."
On 14-12-2009, this court directed respondents to consider and dispose of the representation dated 31-08-2009 within two weeks from the date of receipt of the order.
This court is of the view that if the representation is considered and disposed of, the disposal gives fresh cause of action and the petitioner has to work out the remedies independently against such disposal. In the alternative, if the representation remains unattended as on date, in spite of the direction of this Court, this court is satisfied that the interim order dated 14-12-2009 can be made final order and respondents shall pass orders on the representation dated 31-08-2009 within six weeks from the date of receipt of a copy of this order. The writ petition is disposed of as indicated above. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
