THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.30117 of 2017 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise (A.P) for the respondents.

When the matter is taking up, it is submitted by learned counsel for the petitioner so also learned Government Pleader that the issue in the present writ petition is squarely covered by the order of this Court in W.P.No.21020 of 2017, dated 28.06.2017. A copy of the same is placed on record along with writ petition material papers. The operative portion of the said order reads as under: " 7.

Considering these circumstances, the petitioner is directed to make an application before the Deputy Commissioner of Prohibition & Excise, Khammam (2nd respondent) enclosing thereto a Fixed Deposit Receipt (FDR) drawn in favour of the 2nd respondent on any nationalized bank for a sum of Rs.30,000/- (rupees thirty thousand only) and on such application being made, the interim custody of 50 bags of black jaggery each containing 50 kgs seized in C.O.R.No.264 of 2017 shall be entrusted to the interim custody of the petitioner." In view of the same, this writ petition is also disposed of, keeping it open for the petitioner herein to make an application before the Deputy Commissioner of Prohibition & Excise, Kurnool (second respondent) enclosing thereto a Fixed Deposit Receipt (FDR) drawn in favour of the second respondent on any nationalized bank for a sum of Rs.1,60,000/- (rupees one lakh and sixty thousand only) and on such application being made, the interim custody of 9092 kgs of black jaggery seized in C.R.No.112 of 2017 shall be entrusted to the petitioner.

Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs.
