HON'BLE SRI JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT APPEAL No. 423 OF 2007 JUDGMENT: (per the Hon'ble Sri Justice Dilip B. Bhosale) None appears for the parties.

This writ appeal is directed against the order dated 13-04-2007 passed in Writ Petition No.7351 of 2007 filed by the appellant. In the writ petition, the appellant had challenged the show cause notice dated 06-04-2007 calling upon him to show cause as to why it should not be treated that he had played fraud and secured employment in the respondent - Company. The learned single Judge had refused to interfere with the show cause notice in writ jurisdiction of this Court. While dismissing the writ petition, the time to file reply to the show cause notice, was however extended with direction the respondents to decide the show cause notice on merits in accordance with law. It appears that at the time of filing the writ appeal (in 2007), the appellant was 56 years old.

In view thereof and with the passage of time, it appears that he has lost interest in prosecuting this writ appeal further and, therefore, no body is coming forward to work it out. Hence, we are constrained to dismiss this writ appeal for nonprosecution. Order accordingly. Miscellaneous petitions, if any, also stand disposed of. There shall be no order as to costs.
