HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4748 of 2011 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioners/A2 to A4 seeking to quash the proceedings against them in CC No. 488 of 2010 on the file of X Metropolitan Magistrate, Malkajgiri, Cyberabad, registered for the offences under Sections 498-A & 506 IPC and Sections 4 & 6 of Dowry Prohibition Act, 1961.

A2 is the mother and A3 and A4 are the married sisters of A1. Having regard to the submission of learned counsel for second respondent/ de-facto complainant that in this case the trial proceeded against A1 and he was convicted as per the judgment dated 30.3.2015 of the X Metropolitan Magistrate, Malkajgiri, Cyberabad, it is not a fit case to quash the proceedings against petitioners/A2 to A4. However, they are given liberty to seek for discharge, in which case, the trial Court shall pass an appropriate order on merits. Having regard to the fact that the petitioners/A2 to A4 are ladies and petitioner/A2 is aged more than 60 years, their presence before the trial Court is dispensed with except on the occasions when the trial Court requires their attendance. Accordingly, Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _________________________ U. DURGA PRASAD RAO, J Date: 15.06.2018 KA
