Petitioner prays for the following relief :- " .... to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in allotting the land of the petitioner covered by S.No.12/ 1 an extent of Ac .4-61 cents and S.No.12/ 2 an extent of Ac .0-51 cents of Venkatareddypalem Village, Ozili Madal, without following due process of law as illegal and arbitrary and consequently direct the respondents not to interfere with the possession and enjoyment of the petitioner in respect of the land in S.No.12/ 1 an extent of Ac .4-61 cents and 12/ 2 an extent of Ac .0-51 cents of Venkatareddypalem Village, Ozili Mandal or alternatively direct the respondents to acquire the land in S.No.12/ 1 an extent of Ac .4-61 and 12/ 2 an extent of Ac .0-51 cents under the provisions of Land Acquisition Act and pay compensation..."
3rd respondent has filed counter affidavit and paragraph '7' thereof reads as under :- " For the reasons stated in the preceding paras, it is clear that in pursuance of the orders of the Sub-Collector, Gudur, the petitioner's lands were eliminated from the process of acquisition/ for payment of compensation in accordance with law and a panchanama was conducted on 5.8.2016 and handed over the possession of the above lands to the writ petitioner."
Counsel for petitioner requests the Court to place the stand of respondents on record and close the writ petition. By placing the above statement on record, the writ petition is closed accordingly. No order as to costs.
