Heard the Assistant Government Pleader for Home for the first respondent and Mr.N.Aswartha Narayana for the second respondent. 3.

The present writ petition was filed complaining inaction in investigating crime No.1/2013 dated 04.01.2013 pending before the first respondent as illegal and unconstitutional. The Assistant Government Pleader basing on instructions submits that the first respondent after realizing that the alleged crime has not happened within his jurisdiction transferred it to III Town Police Station, Kurnool and the same is renumbered as crime No.199/2013. In view of the transfer of crime, the cause against crime No.1 of 2013 cannot and could not be considered by this Court.

The Writ Petition fails and is accordingly dismissed. 5.
