THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3138 of 2016 ORDER:

This Criminal Petition is filed by the petitioners-accused Nos.3 & 5 seeking to quash the proceedings against them in Crime No.27 of 2016 on the file of the Akividu Police Station, West Godavari District. The petitioners are alleged to have committed the offences punishable under Sections 342, 307 r/w.34 IPC. It is alleged that when the de facto complainant and others offering prayers in the Central Baptist Church, Wulvertanpet, Akividu on 31.01.2016, the petitioners along with others, came in a group to the Church premises and obstructed the prayers. The de facto complainant questioned them as to why they are obstructing the prayers, then the petitioners and others attacked him and beat him indiscriminately with hands and legs and one of them beat him with an iron rod on the head, due to which bleeding injury was caused to the de facto complainant and they all tried to kill him.

Considering the facts and circumstances of the case and since the allegations made against the petitioners are so serious in nature, this Court is not inclined to interfere with the proceedings against the petitioners in the above CC. The petitioners are at liberty to approach the Court concerned by invoking the provisions under Section 438 Cr.P.C., and the Court concerned shall consider the same in accordance with law.

Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. _______________ RAJA ELANGO, J March 11, 2016.
