HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE MS.JUSTICE J. UMA DEVI WRIT PETITION No.16907 OF 2018 ORDER: (per V. Ramasubramanian, J) The petitioner, who is now working as a Superintendent in the District Court, has come up with the above writ petition challenging a notice to show cause as to why the promotion earlier granted to him should not be cancelled.
2. Heard Mr.D.Linga Rao, learned counsel for the petitioner.
3. What is challenged is only a show cause notice. Therefore, all the points raised by the petitioner in the writ petition should first be canvassed before the Authority which issued the show cause notice so that the attention of the authority is drawn to the various legal aspects. The show cause notice proceeds only on the basis of a circular issued by the High Court. It is only when the petitioner presents his view points, the authority which issued the show cause notice can take an appropriate view. Therefore, we do not wish to entertain the writ petition at this stage.
4. The writ petition is, therefore, disposed of granting time to the petitioner to reply to the show cause notice on or before 31.05.2018. Thereafter, the District Judge shall independently consider all aspects, without being clouded in its thinking by the stand taken in the show cause notice and pass appropriate orders in accordance with law.
